Former President Daniel Moi’s son Philip got a reprieve on Thursday after the Court of Appeal allowed him not to pay his estranged wife millions of shillings.
Appellate judges Martha Koome, Mohammed Warsame, and Philomena Mwilu put on hold the execution of a ruling that directed Philip to pay Ms Rossana Pluda Moi a Sh30 million lump sum among others.
“Having heard the application, we give an order stopping execution of the judgment and decree of the High Court until the appeal is heard and determined,” ruled the judges.
150,000 MAINTENANCE
They, however, ordered Mr Moi to continue paying Ms Pluda Sh150,000 in monthly maintenance and any accrued balance until the appeal is determined.
High Court Judge Luka Kimaru in March ordered Philip to pay Ms Pluda a lump sum maintenance of Sh30 million after the two agreed to end their marriage.
He also ordered the former President’s son to provide Ms Pluda with a house in Runda, Lavington, Kileleshwa, Kilimani, Karen or any other upmarket area of Nairobi, or in the alternative, pay her Sh60 million.
Mr Moi, through senior counsel Tom Ojienda, however, appealed the judgment, arguing that he is unable to raise the amount.
